NES Health Wind Down FAQ
1. Why are contracted providers not being paid? What about backpay from previous months?
Answer: In recent months, NES America has experienced significant financial difficulties that have left NES with no funding or available cash. Consequently, NES has been unable to make payments to key vendors/contractors. W-2 providers will be paid through late November 2024, and benefits will remain in-tact through November 2024. Information on COBRA will be sent to applicable parties to the home address on file.
2. What does this mean for administrative staff?
Answer: Given NES’s difficult decision to wind down and cease operations, administrative staff will be laid off in late November 2024. All payroll liabilities (salary, benefits, accrued PTO) will be funded through the effective date. Information on COBRA will be sent to applicable parties to the home address on file. We sincerely regret having to make this decision.
3. How can NES run out of money when we were told things are going to be stable?
Answer: We understand how frustrating and confusing this situation must be, especially when earlier statements from previous management may have indicated otherwise. It’s important to remember that financial stability can be affected by a number of unforeseen factors. While promises were made based on the information available at the time, circumstances can evolve rapidly, and the situation unfolded in a way that was unexpected. While we cannot follow through on previous management promises, we believe it’s important to be transparent with you despite these difficult circumstances so you can best prepare a path to move forward without NES.
4. When is the date of no malpractice tail coverage?

5. Please confirm for me, as per my signed contract, that I will be provided with tail insurance coverage effective the time and date of the end of my claims-made malpractice coverage through the company.
Answer: Given NES’ recent financial difficulties, NES has been unable to pay key vendors. Such payments that were not made included premiums for medical malpractice coverage (including tail coverage). As a result, NES malpractice coverage lapsed on November 24, 2024. Given NES’s difficult decision to wind down and cease operations, malpractice insurance will not be reinstated.
6. I did not receive my last paycheck. I received a statement on ADP, but nothing was deposited in my bank?
Answer: Final payroll for both administrative and provider staff is being processed through late November 2024. All employee pay was sent by ADP on November 26 and November 27. Note, it may take up to three business days for your bank to process funds to your account. If you have not received your pay by December 1, 2024, or have questions, please email [email protected] with the subject “Payroll.”
7. This is a breach of contract – NES remains contractually obligated.
Answer: Unfortunately, due to difficult financial circumstances, NES does not have resources to perform any further contractual obligations. We realize our decision to wind down and cease operations comes with challenges and may have come as a surprise.
